IMPORTANT NOTICE TO ALL COMMUTERS


ALL COMMUTERS ARE KINDLY REQUESTED TO READ AND BE REMINDED TO TAKE NOTE OF THE FOLLOWING PROVISIONS WHICH CONTAIN THE TERMS AND CONDITIONS EXEMPTING, EXCLUDING AND/OR LIMITING THE LIABILITY OF SINDO FERRY PTE LTD (FORMERLY PENGUIN FERRY SERVICES PTE LTD) IN RESPECT OF, AMONG OTHERS, DEATH, PERSONAL INJURY AND LOSS OF OR DAMAGE TO ALL PROPERTY, INCLUDING BAGGAGE. THESE PROVISIONS SHALL FORM PART OF THE PASSAGE CONTRACT BETWEEN THE COMMUTER AND THE COMPANY AND APPLY TO ALL PASSAGES ON-BOARD THE COMPANY’S FERRIES AND BOATS, AND THE COMPANY RESERVES THE RIGHT TO AMEND THESE PROVISIONS FROM TIME TO TIME WITHOUT NOTICE TO COMMUTERS. COMMUTERS ARE KINDLY ADVISED TO PURCHASE APPROPRIATE AND ADEQUATE INSURANCES TO PROTECT THEMSELVES AND THEIR PROPERTIES.


1.Definition of Customer Data
 
 Customer Data in this Policy is being categorised into two different types, depending on the type of the service requested and/or transaction made.
 
 1.1We collect, use and disclose your Customer Data, which includes but is not limited to:
  (a)personal information that links back to an individual e.g., name, gender, date of birth, passport, etc.
  (b) contact information e.g., address, phone number, email address
  (c) travel information e.g., trip information
 1.2Statistical Data, which is information on the number of passengers carried and the behaviour of visitors to our website. We automatically track certain information based upon your behaviour on the Site. We automatically track certain information based upon your behaviour on the Site. We use this information to do internal research on our users’ demographics, interests, and behaviour to better understand, protect and serve you. However, this information will not be stored on your customer record, and is entirely anonymous.
  
2.Purposes for Collection, Use and Disclosure
 
 2.1How Do We Collect Customer Data?
  We may collect personal information about you when you use our services, make or update a booking to use our services, register to receive our newsletters or other communications, register to be part of one of our Loyalty programs, enter into one of our competitions, visit our websites, complete one of our surveys or otherwise interact with us. As well as collecting information directly from you, there may be occasions when we collect information about you from a third party. These third parties may include:
  (a)Travel agents and other people who make or update travel bookings on your behalf, or otherwise interact with us on
   your behalf, including when you make an inquiry with a travel agent but do not proceed to a booking;
  (b)Third parties that run competitions and other promotions for us or for which we are the sponsor;
  (c)Immigration, customs, border security and other regulatory authorities;
 
 2.2How Do We Use Customer Data?
  We may use your personal information for the following purposes:
  (a)To provide and administer our goods and services, including verifying your identify; contacting you about your
   bookings and travel, and other arrangements; processing payments; training our staff; testing our systems;
  (b)To provide and operate our competitions, promotions and events;
  (c)To distribute our newsletters and other communications either ourselves or with the assistance of third party services
   providers;
  (d)For customer support, including resolving and providing assistance for mishandled or missing baggage claims or
   responding to other enquiries or requests;
  (e)To ensure the safety and security of all passengers when travelling with us, including investigating security and
   screening issues;
  (f)To facilitate your participation in the Loyalty Programs and loyalty programs of other program partners;
  (g)To conduct marketing activities for our products and services, or products and services of third parties, and
   to conduct market and other research to improve our products, services and marketing activities;
  (h)To maintain records and comply with our legal obligations, including laws relating to immigration, customs,
   safety and security.
 
 2.3Who Do We Disclose To?
  Sindo Ferry may disclose your Customer Data with and to third parties in order to fulfil the purposes listed above. Third Parties include travel and freight service providers or travel-related businesses, terminal and seaport management, security personnel, and other carriers for the purpose of your travel arrangement.
 
  Sindo Ferry may also disclose your Customer Data to law enforcement agencies and government for security, customs and immigration purposes. For example, Sindo Ferry and other carriers are required by laws in Singapore and other countries to provide Immigration and Checkpoints Authority (“ICA”) with access to your booking information or trip itinerary. Please be informed that the initial recipients of such information may share your booking data with other government agencies or enforcement authorities.
 
  Sindo Ferry shall use its best endeavours that its employees, officers, agents, consultants, contractors and such other third parties above who are involved in the collection, use and disclosure of Customer Data will observe and adhere to the terms of this Privacy Policy.
 
  Other than the above, we will not disclose your personal information without your consent unless it is either authorised or required by law, necessary to prevent a threat to life or health, reasonably necessary to enforce legal regulations, or necessary to investigate suspected unlawful activities including but not limited to fraud, intellectual property infringement or privacy.
  
3.Disclosure of Information Overseas
 
Sindo Ferry head office is based in Singapore. Customer Data may be transmitted to central data storage facilities where we keep our records. Customer Data may be transferred to Sindo Ferry’s offices and appointed agents in Singapore or other countries in connection with Sindo Ferry’s performance of the contract with you.
  
4.Consent
 
In the course of Sindo Ferry performing functions such as making a trip booking, Customer Data will, by nature of the task or transaction, be provided by our customers and passengers to Sindo Ferry. In such instances, consent will necessarily be implied from the Customer that they are agreeable to providing Customer Data in order for Sindo Ferry to provide and/or process the requested or necessary service to them. However, where required by law, Sindo Ferry will adopt an ‘opt-in’ policy for obtaining customer consent, in which event, express written consent will be sought from you when collecting your Customer Data e.g., signing a form or checking a box. Where you make reservations on behalf of another person, you undertake and will ensure that the individual whose Customer Data is supplied to us has authorised the disclosure, is informed of and consents to the terms and conditions of this Privacy Policy.
 
Statistical Data is not linked to a Customer Data and therefore, Sindo Ferry will not seek consent for the collection, use or disclosure of Statistical Data.
  
5.Access and Correction Information of Customer Data
 
If you would like to request access to, or correction of, Customer Data we hold about you, please contact our Customer Service Department. Where permitted by law, we may recover from you our reasonable costs of supplying you with access to this information. However, we will not charge you for the making of the request or to correct or update your Customer Data.
 
In exceptional circumstances, Sindo Ferry reserves the right to refuse to provide you with access, or correct, the Customer Data.
  
6.Security Safeguards
 
For Customer Data that collected through Sindo Ferry’s website, we implement a variety of security measures to maintain the safety of your Customer Data when you place an order or enter, submit, or access your Customer Data. We offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway providers database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential.
 
After a transaction, your Customer Data (credit cards, social security numbers, financials, etc.) will not be stored on our servers. However, “perfect security” does not exist on the Internet, so we cannot give an absolute assurance that the information you provide to us will be secure at all times, and we cannot responsible for any event arising from unauthorised access to your Customer Data. We will not be held responsible for events arising from third parties gaining unauthorised access to your Customer Data.
 
Internally, we have procedures in place that require our employees and data processors to respect the confidentiality of any Customer Data held by us. The offline Customer Data (if any) is secured with appropriate security technologies.
  
7.Cookies
 
Cookies are small files that a site or its service provider transfers to your computer hard drive through your Web browser (if you allow) that enables the sites or service providers systems to recognise your browser and capture and remember certain information. We use cookies for the following reasons:
 
 (a)To remember and process the items in your shopping cart;
 
 (b)To improve your website browsing experience. For example, to remember your search criteria so you do not have to
  re-enter them to do multiple searches and to remember your site preferences for your next visit to the site;
 (c)Gather statistics on site usage. For example, page views and drop off points so we can monitor site usage and
